Important Notice: These Terms & Conditions govern your relationship with NRS Eretz Realty and contain important provisions including dispute resolution by arbitration, limitation of liability, and buyer due diligence obligations. Please read all sections carefully. If you have questions, contact us before using our services.

1. Acceptance of Terms

By accessing or using the NRS Eretz Realty website (nrseretzrealty.com) or engaging our services in any manner — including property enquiries, site visits, or investment consultations — you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"), along with our Privacy Policy.

If you do not agree with any part of these Terms, you must immediately discontinue use of our website and services. These Terms constitute a legally binding agreement between you ("User", "Client") and NRS Eretz Realty ("Company", "we", "us").

2. Eligibility

To use our services, you must:

- Be at least 18 years of age and possess the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
- Not be prohibited from acquiring immovable property in India under applicable laws, including the Foreign Exchange Management Act, 1999 (FEMA) for non-resident Indians (NRIs) and foreign nationals.
- Provide accurate, complete, and up-to-date information when submitting enquiry forms or engaging in transactions.

NRI and OCI cardholders may acquire agricultural land, plantation property, or farmland only with prior specific approval from the Reserve Bank of India (RBI) under applicable FEMA regulations. Our team will guide eligible NRI investors accordingly.

3. Nature of Our Services

NRS Eretz Realty provides the following services:

- Property Advisory: Identifying and presenting premium farmland and land investment opportunities in Telangana and surrounding regions.
- Site Visit Facilitation: Arranging and conducting physical site visits to properties in our portfolio.
- Transaction Assistance: Assisting buyers with due diligence, legal documentation, and coordination with registration authorities.
- Investment Consultation: Providing market insights, investment analysis, and ROI projections based on publicly available data and our expertise.

Important Disclaimers:
- NRS Eretz Realty is a real estate advisory and facilitation company. We are not a bank, financial institution, or registered investment advisor under SEBI regulations.
- Property investment involves inherent risks including market fluctuation, regulatory changes, and natural events. Past performance is not indicative of future results.
- All ROI projections and appreciation estimates are indicative and based on historical market data. They do not constitute guaranteed returns.

4. Property Information & Accuracy

We strive to provide accurate property information including price, size, location, and legal status. However:

- Information Currency: Property details, availability, and prices may change without notice. All listings are subject to availability at the time of formal agreement.
- Verification: While we conduct due diligence on all listed properties, buyers are strongly advised to independently verify all property details, title documents, encumbrances, and legal status through their own legal counsel before executing any purchase agreement.
- Measurements: Land measurements displayed are approximate. Exact measurements shall be confirmed through official survey records (pahani/adangal) and registered sale deed.
- Images: Photographs and aerial imagery on our website are representative and may not reflect the exact current condition of every property.
- Government Approvals: Mention of approvals (e.g., HMDA, RERA, panchayat permission) is based on documents provided by property owners/developers. Buyers must independently verify all approvals with relevant authorities.

5. Booking, Payments & Transactions

Token Amount & Booking:
- A token/advance amount may be required to book a property and remove it from active listings. Booking terms, token amounts, and payment schedules are specified in the individual Sale Agreement.

Sale Agreement:
- All property transactions are governed by a formal Sale Agreement / Agreement for Sale executed between the buyer and seller. NRS Eretz Realty facilitates but is not a party to these agreements.

Payment Terms:
- Full payment terms, installment schedules (if applicable), and bank financing options are detailed in the individual Sale Agreement.
- All payments must be made through legitimate banking channels (RTGS/NEFT/cheque) as required under PMLA and Income Tax laws. Cash transactions exceeding limits prescribed under the Income Tax Act are prohibited.

Cancellation Policy:
- Cancellation terms are governed by the Sale Agreement between buyer and seller.
- Token amounts may be forfeited in case of cancellation by the buyer, as specified in the agreement.
- In case of cancellation due to title defects discovered post-booking, refund terms will be negotiated in good faith.

6. Buyer's Due Diligence Responsibility

The purchase of immovable property is a significant financial and legal transaction. Buyers are solely responsible for conducting adequate due diligence, including but not limited to:

- Obtaining an independent legal opinion from a qualified property lawyer regarding title clarity, encumbrances, litigation history, and succession disputes.
- Verifying revenue records (pahani, adangal), survey documents, and mutation entries at the local tahsildar office.
- Confirming land-use permissions, zone classifications, and agricultural land conversion status where applicable.
- Reviewing any existing loans, mortgages, or liabilities attached to the property through Sub-Registrar office searches.
- Assessing soil quality, water availability, access roads, and other physical attributes personally.

NRS Eretz Realty provides facilitation and advisory services in good faith. We are not liable for title disputes, third-party claims, or encumbrances that were not disclosed by the property owner and not discoverable through reasonable inquiry at the time of listing.

7. Intellectual Property

All content on the NRS Eretz Realty website — including text, photographs, logos, graphics, video content, property descriptions, and website design — is the proprietary property of NRS Eretz Realty or licensed to us.

You may not:
- Copy, reproduce, distribute, or commercially exploit any content from our website without prior written permission.
- Use our brand name, logo, or trademarks in any manner that suggests affiliation or endorsement without written authorisation.
- Screen-scrape, data-mine, or use automated tools to extract property listings or information from our website.

Limited, non-commercial personal use (e.g., saving property details for personal reference) is permitted.

8. Prohibited Activities

You agree not to use our website or services to:

- Misrepresent your identity, financial capacity, or investment intent.
- Submit false or misleading enquiries that waste our team's resources.
- Engage in money laundering, tax evasion, or any activity prohibited under PMLA, Income Tax Act, or other applicable laws.
- Attempt to contact property sellers directly by bypassing our advisory process in bad faith after receiving proprietary property information.
- Reverse-engineer, hack, or attempt to gain unauthorised access to our website systems.
- Post defamatory, false, or misleading reviews or content about our services.

Violation of these prohibitions may result in termination of services and legal action.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

- No Guarantee of Returns: NRS Eretz Realty makes no guarantees regarding property price appreciation, rental yields, or investment returns. All such figures are estimates based on market analysis.
- Third-Party Actions: We are not liable for the actions, omissions, or misrepresentations of property sellers, developers, government authorities, or any third party involved in a transaction.
- Website Availability: We do not guarantee uninterrupted, error-free website operation. We are not liable for losses caused by website downtime or technical errors.
- Maximum Liability: Our total liability to you for any claim arising from use of our services shall not exceed the service fees paid by you to NRS Eretz Realty for the specific transaction in question.

Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be legally limited.

10. Dispute Resolution & Governing Law

Governing Law: These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana.

Dispute Resolution Process:
1. Informal Resolution: In the event of any dispute, both parties shall first attempt to resolve the matter amicably through good-faith negotiation within 30 days of written notice.
2. Mediation: If informal resolution fails, parties agree to attempt mediation through a mutually agreed mediator.
3. Arbitration: Unresolved disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual agreement. The seat of arbitration shall be Hyderabad, Telangana. Proceedings shall be conducted in English.
4. RERA: For disputes relating to registered real estate projects, you may also approach the Telangana Real Estate Regulatory Authority (TGRERA).

Nothing in this clause prevents either party from seeking urgent interim relief from a court of competent jurisdiction.

11. Indemnification

You agree to indemnify, defend, and hold harmless NRS Eretz Realty, its directors, employees, agents, and partners from any claims, losses, damages, costs, or liabilities (including reasonable legal fees) arising from:
- Your breach of these Terms or our Privacy Policy.
- Your violation of any applicable law or third-party rights.
- Your use of our website or services in an unauthorised or improper manner.
- Any misrepresentation made by you in connection with a property transaction.

12. Amendments to These Terms

NRS Eretz Realty reserves the right to modify these Terms at any time. Material changes will be notified via:
- A prominent notice on our website homepage.
- Email notification to registered users (where reasonably practicable).

The updated Terms will be effective from the "Last Updated" date displayed. Your continued use of our services after notification of changes constitutes acceptance of the revised Terms. If you disagree with any changes, you must discontinue use of our services.
